By using this website, registering and/or submitting your story, you are agreeing to the following
Terms of Service:
By using this Website, registering, and/or submitting your story, you are agreeing to our Terms of
Service Agreement, Promotional Materials Usage Agreement, our Privacy Policy, and all other site policies
expressed in web pages or communicated through other common forms of communication, such as email notices,
instructions, tutorials or downloadable documents.
Our primary objective is to provide a public forum which allows entrepreneurial bootstrappers to share
their stories and gain recognition for their efforts. As a story submitter, you are a vital part of our
efforts. Our aim is to provide relevant, useful content to aid individuals who are making important
choices about bootstrapping in the context of entrepreneurial work and lifestyle alternatives. On behalf
of our visitors, we thank you for your contributions in that regard. Please follow our submission
guidelines carefully to ensure the successful publication of your story and associated content:
I. DEFINITIONS
BootstrappingStories.com is a publisher (e.g., producer and distributor) of information and media which
may include Web content on specific Web sites, i.e., this site as well as other sites that it may own or
be associated with directly, or with which it may maintain strategic alliances, affiliations, agreements
and business relationships, now or in the future. Our business interests extend to a variety of
electronic and traditional print mediums to include (but are not limited to): e-zines (electronic
magazines), newsletters, electronic compilations, information booklets, reports, books and e-books
(electronic books), Web sites, audio and video media, live events (such as seminars, trade exhibitions,
awards and recognition programs), and any other means by which we may in our own best judgment efficiently
reach and serve our audiences. Therefore, any reference to BootstrappingStories.com shall be considered
synonymous with us as the "publisher" of stories and associated content (such as biographical information,
tips, advice, favorite quotes, photos, images, text, audio or video) that may be submitted to us by you as
the original "author" and owner of that content. Author submissions constitute an "Agreement" that you
understand and will follow our guidelines, content submission and usage policies; generally, you as an
author are submitting content (and the rights to publish and promote that content) to us as the publisher
for dissemination to our Web site visitors and consumers by any other means as described above.
II. PERMISSION GRANTED
By submitting your story and content to BootstrappingStories.com you are granting your permission (and
all necessary rights under U.S. and International Copyright Conventions) to publish and promote (e.g.,
through media releases and other marketing communications efforts) your story and associated content as
defined in Section I., above. If you do not agree to our policies or meet the authorization qualifications
(i.e., you do not own the legal rights to the material being submitted), do not submit any story or
associated content. You are giving permission for your story and associated content to be reprinted in
electronic, print publications, and any other media which we as the publisher of your submission may
utilize, now and in the future, as outlined in the above DEFINITIONS Section; the rights you are granting
are irrevocable and in perpetuity, excepting expiration provisions under prevailing copyright law. Except
for the rights that you are granting under the provisions outlined here, authors otherwise retain full
copyright ownership of all of their content. Any person or entity that sends any submission also warrants
that they are the rightful copyright owner, creator, or author of any content that is submitted, with the
full legal authority to convey the publication rights specified herein.
III. AUTHOR ACKNOWLEDGEMENT
It is the publisher's policy to collect and display certain information such as author by-lines,
biographical information, photographs and images, affiliations, and similar contact information such as
regular mail and e-mail addresses, telephone numbers, URL's, and the like for purposes of providing public
recognition and other potential benefits for authors and their businesses. Authors should provide all such
information as requested in the submissions process; this policy extends to all of its publication mediums
as described in the above DEFINITIONS Section, and is subject to the provisions outlined in the DISPLAY
Section below; such acknowledgements provided to authors by the publisher and any recognition or other
benefits that may accrue to authors shall be considered value received and compensation in full to authors
by the publisher. Because any submitted information and associated content may become publicly visible, it
is essential that you review our Privacy Policy Statement, which is incorporated herein by reference.
IV. DISPLAY
The publisher reserves the right to make formatting adaptations, editorial changes, and other decisions
that affect the publication and display of all submitted stories and associated content at its sole
discretion. Examples may include (but are not limited to):
1) Copy editing to implement any corrections that may be necessary to eliminate typos or grammatical
errors (notwithstanding this editorial privilege granted to the publisher, submissions that fail to meet
acceptable quality standards may be rejected entirely or sent back to the author for revisions).
2) Story submissions are not automatically granted publication or display space, and any publication is
at the sole discretion of the publisher.
3) The publisher may determine if, when, where and how information about the authorship and
acknowledgements associated with any story or associated content (or portions thereof such as author name
versus contact information, et al.) will be displayed, depending on the particular type of medium or
method of dissemination, display constraints, or aesthetic considerations that may apply, as determined by
the publisher. Author by-lines are normally displayed at the beginning and/or the end of a given story,
but in some publication forms or mediums acknowledgement may be given in a bibliographic or a similar
(separate) author credits section; the publisher also reserves the right to place limits and exercise
editorial discretion with respect to acknowledgements: authors should provide a succinct list of durable
and reliable ways through which they may be contacted.
4) No story or associated content is guaranteed preferred positioning, exclusivity, or display space by
itself without accompaniment by other content which may include promotional, advertising, editorial,
affiliate, or other matter.
5) All aesthetic, design, creative, layout and production decisions are at the discretion of the
publisher (because design and production decisions do ultimately affect development, publication and
dissemination costs, usability, and desirability in every medium, whether it may be traditional print or
electronic in nature).
6) While the publisher will naturally attempt to continually maintain current and relevant information
as part of its service to its users (including authors' information), it is under no obligation to do so:
authors acknowledge that some mediums are inherently subject to aging (such as printed materials), and
that it is their obligation to provide up-to-date contact information as well as any suggested updates to
previously submitted stories (including the suggested new content itself). In connection with the issues
surrounding information maintenance expressed in this section, it is further understood that the publisher
shall also have the right to provide indexing, storage and retrieval systems and/or organize stories in
any manner it deems appropriate, and may categorize stories by topic, date, or any other hierarchical
pattern, including that which may ultimately be held in archives.
V. EDITORIAL
GUIDELINES
If you have sound advice that pertains to entrepreneurial bootstrapping that can be shared in the
context of a bootstrapping story, it is extremely likely that our audience would appreciate your content,
and we would be delighted to publish your submission as long as it meets our guidelines and serves our
audiences. If you have an article or advice that is to be conveyed in a context other than an
entrepreneurial bootstrapping story, please do not submit your content to this site: allow us to welcome
your content in a more appropriate venue, such as our associate site (under development),
EntrepreneurshipArticles.com.
We will publish your acceptable material as fast as we can, and we look forward to your continued
success!
1) We would really prefer to AVOID becoming involved in policing submissions, so please do not engage
in practices such as writing a sales letter and calling it a bootstrapping story, submitting work that is
filled with typos and other errors, or otherwise submitting content of unacceptable quality. Engaging in
libelous, defamatory, or other inappropriate writing practices will result in content being rejected and
possible additional action (such as site banishment and/or litigation). We believe that we have created a
significant window of opportunity for you to provide interesting, informative, and entertaining content
that can possibly reach an important audience of significant size. Therefore, please submit your best work
and protect your image as well as our viability as a publishing outlet for you by submitting quality
content, accurate, and relevant information.
2) Material omissions, falsification or other purposeful acts of misrepresentation are strictly
unacceptable and shall result in site banishment and the revocation of any rights or privileges granted
hereunder as well as additional consequences such as possible litigation against the submitter.
VI. INDEMNITY
Notwithstanding any of the publisher's rights, privileges or other provisions herein, in submitting any
content, visiting or using this site, you are agreeing to INDEMNIFY, protect, and hold harmless
BootstrappingStories.com as publisher, its affiliates, business associates, Sponsors, Friends, Editors,
Advisory Board Members, or assigns, from any and all claims that may arise whatsoever, such as those
arising from false, misleading, inaccurate, libelous, defamatory, negligent or erroneous statements you
make, or unauthorized content and ownership claims (e.g., copyright violations) in association with
content that you submit. In accordance with the Digital Millennium Copyright Act (DMCA), this site will
cooperate with notices that are in connection with legitimate claims of copyright infringement, sometimes
known as "takedown notices," and specifically disclaims responsibility for your inappropriate and/or
illegal acts; we reserve the right to seek damages for any costs or consequences arising as a result of
your inappropriate and/or illegal acts. Individual copyright owners who wish to contact us in regard to
any allegations pertaining to copyright violations may do so using our online contact information.
INDEPENDENCE OF EDITORS AND ADVISORY BOARD MEMBERS
BootstrappingStories.com Editors are independent persons who volunteer their services to moderate
website content submissions. Advisory Board Members are independent persons who volunteer their services
to provide input regarding the operation of the site itself. Some Editors and Advisory Board Members
maintain independent businesses of their own, or provide services as individuals. Any relations between
BootstrappingStories.com story submitters, Editors, Advisory Board Members, or site visitors are strictly
by and between said parties, and separate from BootstrappingStories.com, whether such relations may be
positive and harmonious or associated with disputes and disharmonious, said parties and relations shall at
all times be independent of BootstrappingStories.com, and are subject to these INDEMNITY provisions.
VII. WARRANTY
THIS SITE AND ITS CONTENTS ARE PROVIDED AS-IS, AND ALL WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A
PARTICULAR PURPOSE ARE DISCLAIMED. We also specifically disclaim any and all responsibility for the
representations made by: 1) independent persons or contractors (e.g., BootstrappingStories.com Editors and
Advisory Board Members); 2) individuals (e.g., Registered Users) whose content we display; and 3) any
third party sites whose links we may display, or which may link to us, including sponsors, advertisers,
and Websites identified as friends, associates, affiliates, marketing or business partners, resource
links, or the like.
VIII. DISPUTES AND LEGAL PROVISIONS
Choice of Law and Venue
This Terms of Service Agreement shall be interpreted under the laws of the Rutherford County, State of
Tennessee, USA. Any/all disputes or litigation shall be resolved by a court of competent jurisdiction in
Rutherford County, State of Tennessee, USA.
Attorneys Fees
In the event of any dispute and/or litigation relating to the subject matter of this Agreement, the
non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs
resulting therefrom.
Severability
This Terms of Service Agreement shall remain enforceable even if part of the Agreement is later held
invalid, i.e., if any provision of this Agreement is held unenforceable, then such provision will be
modified to reflect the intentions of BootstrappingStories.com. All remaining provisions of this
Agreement shall remain in full force and effect.
Non-Waiver
The failure of BootstrappingStories.com to require performance of any provision shall not affect its
right to require performance at any time thereafter, nor shall a waiver of any breach or default of this
Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
Modifications and Notices
We reserve the right to make changes to and/or modify this Terms of Service Agreement and all such
Agreements and policies incorporated herein by reference from time to time and at our sole discretion, for
any reason, or for no reason; posting any such changes on this website shall constitute sufficient notice
being given to any registered user, member, Editor, Advisory Board Member, or other individual or entity
identified as a sponsor, advertiser, friend, associate, affiliate, marketing or business partner,
resource, or the like, new or returning site visitor.
Entire Agreement
This Agreement and the items incorporated herin by reference contain the entire Agreement of the
parties with respect to the subject matter of this Agreement, and supersede all prior postings, Agreements
and understandings with respect thereto. This Agreement may only be amended by a written document duly
executed by all parties.
IV. CONTENT SUBMISSION INSTRUCTIONS
All content should be submitted using the specific instructions and forms provided on this Web
site.
By submitting your Bootstrapping Story and associated content, you are agreeing to our Terms of
Service; if you do not agree to these Terms of Service, do not submit your story or associated
content.
Promotional Materials Usage Agreement
This Promotional Materials Usage Agreement is in association with and subject to our Terms of Service, which are incorporated herein by reference.
I. INTRODUCTION AND DEFINITIONS
As a user benefit, BootstrappingStories.com may wish to provide you with certain materials for your use in identifying the inclusion of content associated with you on this site, including user roles such as that of a Bootstrapping Story submitter, an Editor, an Advisory Board member (or other role); Friends and Sponsors of the site may also be provided with the same or similar materials, and do hereby also agree to the provisions hereunder. These materials may be provided in either tangible (physical form) such as trophies, plaques, signage and displays, award ribbons, medallions, advertising/promotional specialties, membership cards, certificates, and the like, or in their intangible (symbolic) form, such as downloadable electronic files and artwork. Your authorized usage under these license provisions of BootstrappingStories.com advertising or award and recognition promotional materials and intellectual property including tangible objects, graphics, certificates, slogans, electronic files, information, or art (such as medallions, ribbons, logos, symbols, trademarks or sales marks) or any other supplied materials associated with the BootstrappingStories.com "brand"� (hereinafter "promotional materials",� "materials",� "intellectual property",� or "objects"�) or those of its sister companies, associates, affiliates, partners or entities with which it has established business relationships does not give you any right, title or interest in such promotional materials, other than the licensed usage rights specifically granted herein.
II. REPRODUCTION AND USAGE LICENSE
Subject to the terms of this Agreement, BootstrappingStories.com hereby grants you a non-exclusive, non-transferable, worldwide, royalty-free license to reproduce and use the promotional materials described hereunder. You do not have the ownership rights or authority as a licensee to sell or resell, assign, transfer or sublicense any usage right or rights granted herein without the prior written consent of BootstrappingStories.com. These provisions apply regardless of application or manner of use, whether enacted, facilitated or disseminated in tangible or intangible form, print, electronic, Internet, broadcast or any other medium(s) now in existence or that may arise in the future.
III. NO MODIFICATION
You may not modify, customize or extend the functionality of BootstrappingStories.com promotional materials by changing files, artwork, content, design, layout, file formats, sizes (display sizes or sizes in the context of electronic file sizes), or any other aspect of the supplied promotional materials, except for minor customizations accompanying BootstrappingStories.com supplied installation, usage, reproduction or distribution instructions. You may not subject the BootstrappingStories.com promotional materials to any license terms that are in turn subsumed under any another license or licensee, or purport to share rights to BootstrappingStories.com with any other parties. You may not otherwise adapt, translate, alter or modify the BootstrappingStories.com promotional materials in any way, including but not limited to the removal of installer programs, instructions, specifications, "read me" files, electronic end user license Agreements ("EULA"), registration or serial numbers, or any copyright or other proprietary notice that appears in, on or in association with said promotional materials (whether tangible or intangible in their form). You may not integrate or use electronic versions of the promotional materials with any other software, plug-in or enhancement; you may not include BootstrappingStories.com promotional materials in any compilation, archive, or file for distribution or sale to any third party as a product or service unto itself. You may not
attempt to reverse engineer, decompile, disassemble or otherwise seek to discover the inner workings or components, including the source code of electronic files, of any promotional materials.
IV. PROMOTIONAL MATERIALS TO BE USED IN A FITTING MANNER RELATIVE TO SPECIFIED PURPOSES
All promotional materials should be used in a fitting manner relative to specific applications or purposes for which they are intended as per supplied specifications and/or instructions. For instance: (a) lower resolution web graphics should only be used for Internet display and usage purposes; and (b) higher resolution graphics intended for use with traditional print and reprographic output devices (e.g., printers, copiers, or printing presses) should only be used in association with such devices. Further, associated messages relative to promotional materials should fit the circumstances. For instance, a graphic or message associated with a measure of popularity (e.g., "most popular," a "ten boots" ranking, "as recognized on," "award winner") should only be used by persons or entities whose popularity rankings are actually consistent with the claims. Other messages pertaining to role, ranking, membership status, popularity level, taxonomy or other situation or circumstance should be consistent with and accurate relative to the message in use. You may not claim or suggest by any means of communication whatsoever to be associated with a role, ranking, membership status, popularity level, taxonomy or other situation or circumstance in a manner which may reasonably be considered misleading or untrue.
V. WARRANTIES
BootstrappingStories.com makes no warranties of any kind, either express or implied, with respect to the promotional materials supplied hereunder. BootstrappingStories.com will not be liable to you for any consequential, incidental, or special damages (including loss of business profits or revenues) arising from or related to your use of the promotional materials, objects, or any associated electronic files or data (including defects, flaws, security vulnerabilities or other issues that could affect their functionality) even if BootstrappingStories.com has been advised of the possibility of such damages. If BootstrappingStories.com provides you with substitute promotional materials (including tangible objects) and any associated electronic files or data (posting new materials or announcements as to their availability to this website shall constitute
sufficient notice), you shall bear all responsibility for: (a) adopting said materials (files, objects, et al.); and (b) all liability, risk, or consequences arising from your continued use of the previous promotional materials and any associated objects, electronic files or data.
VI. ACCEPTABLE USE, QUALITY AND USAGE STANDARDS
You agree not to use BootstrappingStories.com award and recognition promotional materials or intellectual property in any way that will disparage the image, reputation, goodwill or brand of BootstrappingStories.com or its product or services, injure its positive reputation or otherwise damage or diminish goodwill in the BootstrappingStories.com brand, or infringe on its intellectual property. For purposes of this Agreement, forms of usage that are not allowed include, without limitation, association with websites, businesses, or individuals that may be considered (by subjectively determined standards at the sole discretion of BootstrappingStories.com) to be engaged in activities that: are unlawful, pornographic, obscene,
defamatory, infringing, threatening, invasive of another's privacy, or racially, ethnically or otherwise objectionable, unethical, unscrupulous or questionable, in poor taste, or provide products or services of poor quality.
VII. SPAM
Sending Unsolicited Bulk Email ("UBE", "spam") including or in association with BootstrappingStories.com promotional materials is strictly prohibited, and any and all consequences or civil/criminal claims arising therefrom are especially relevant to the Indemnification provisions of our Terms of Service Agreement, which is incorporated herein by reference. Sending unsolicited advertising via email ("spamming") is a violation of State and Federal Law and would otherwise constitute a violation of this Agreement. Further, spam policy
violations hereunder include referencing BootstrappingStories.com or any domain or company (e.g., sister company or associate site) in said spam. Such prohibited conduct subjects any person or entity to immediate cessation of all services as provided herein and the termination of any and all usage privileges extended under this Agreement without notice. BootstrappingStories.com reserves the right to report such illegal activities to regulatory, law enforcement, judicial and/or governmental authorities for appropriate prosecution, and to fully cooperate with those authorities in a manner which may aid in the successful prosecution of their claims. In addition, BootstrappingStories.com has the right under this Agreement to levy charges, as well as to seek compensatory and/or other damages to compensate for any and all losses, inconvenience or expenses, including attorneys fees and collections costs; charges, if imposed, shall be levied at prevailing rates which BootstrappingStories.com may determine from time to time, but shall be no
less than three dollars (US $3.00) per email recipient for any such spamming activity.
VIII. OWNERSHIP RIGHTS
You hereby acknowledge the validity of BootstrappingStories.com award and recognition promotional
materials and intellectual property rights and its sole ownership of all such materials and rights, and that BootstrappingStories.com retains all rights, title and interest in these promotional materials and intellectual property, whether they may be represented in their tangible or intangible form. You recognize the value of the goodwill associated with the promotional materials and BootstrappingStories.com brand, and acknowledge that such goodwill shall to inure to the benefit of BootstrappingStories.com, to which said goodwill exclusively belongs.
IX. NO ENDORSEMENT
Your usage practices associated with BootstrappingStories.com promotional materials shall be conducted in a manner that does not lessen, detract from, or interfere with BootstrappingStories.com's rights in said materials. You may not use the promotional materials in any way to suggest (either by inference or explicit statements) an endorsement or sponsorship by BootstrappingStories.com of yourself or any organization, its personnel, or of any of your (or its) product or services.
X. INFRINGEMENT
You agree not to adopt or use a trademark, service mark, or any other designation or materials confusingly similar to or infringe upon the promotional materials and intellectual property owned by BootstrappingStories.com (or associated with its brand). Further, you agree to use the promotional materials only in connection with a business or other entity, products, services, advertising and operational practices that comply with all applicable state and local, U.S., and foreign laws and regulations.
XI. COOPERATION AND COMPLIANCE WITH QUALITY AND USAGE STANDARDS
If BootstrappingStories.com so requests, you agree to submit specifications pertaining to any uses of the promotional materials for approval prior to the dissemination of these materials; such approval may be withheld for any reason at the sole discretion of BootstrappingStories.com. Further, you agree to comply with all such steps BootstrappingStories.com may reasonably request to assist in monitoring and maintaining the applications, communications mediums, quality and manner in which the promotional materials are used. BootstrappingStories.com may review your use of the promotional materials or intellectual property at any time and by any means technologically or otherwise available to evaluate your compliance with the quality and usage standards described in this Agreement.
XII. RECORD CREATION AND MAINTENANCE
You will create and maintain accurate and complete records necessary to identify the locations and applications of your use of the BootstrappingStories.com promotional materials and you will furnish samples associated with such use upon reasonable request from BootstrappingStories.com; failure to comply with this provision may, at our discretion, be considered a breach of this agreement.
XIII. REVOCATION OF USAGE PRIVILEGES
If BootstrappingStories.com determines that you are at any time in breach of the terms and conditions set forth herein, or for any reason whatsoever (with or without cause) at its sole discretion revokes your usage privileges, you shall be subject to the termination provisions set forth as follows: (a) in the event that BootstrappingStories.com provides such an option, you must immediately remedy any material deficiencies in your use of the BootstrappingStories.com promotional materials; or, (b) failing your willingness or actions leading to compliance with this Agreement or demands presented within the time specified in its notice to you, you must immediately cease the use, reproduction, and distribution of all BootstrappingStories.com promotional materials, intellectual property and associated components (e.g., electronic files); (c) you must destroy all copies associated with BootstrappingStories.com promotional materials, intellectual property and associated components in your possession which exist in intangible form; (d) you must submit written certification of such destruction; and (f) in the event that promotional materials are in a tangible form and exist as physical objects, these artifacts must be returned in good condition and at your expense, to BootstrappingStories.com.
Privacy Policy Statement

For each visitor to our Web page, our Web server automatically recognizes the consumer's domain name, I.P. address, e-mail address, and additional tracking data (where possible).
We collect the domain name, I.P. address, e-mail address, and additional tracking data (where possible) of visitors to our Web pages, the e-mail addresses of those who post messages to our bulletin board, blog, or other content submission mechanisms, the e-mail addresses of those who communicate with us via e-mail, the e-mail addresses of those who make postings to our chat areas, aggregate information on what pages consumers access or visit, user-specific information on what pages consumers access or visit, information volunteered by the consumer, such as survey information and/or site registrations, name and address, telephone number, fax number, payment information (e.g., credit card number and billing address).
We will endeavor in good faith to protect sensitive information which you submit such as credit card transaction data, but we hereby disclaim any and all responsibility for internal or third party breaches of data security from terrorists, hackers, criminals, or other individuals or organizations engaged in committing illegal acts of data security penetration; any claim you may have for breaches of data security shall be strictly between you and the individuals who are perpetrators of any such illegal acts.
The information and other content we collect is: 1) typically publicly visible content (submitted on a voluntary basis by Registered Users), which may lead to positive and/or negative consequences entirely beyond our control, and is therefore governed by our Terms of Service agreement, which includes an indemnification policy, and a disclaimer of all warranties whatsoever relative to this site, its usage, and its content; 2) used to improve the content of our Web page; 3) used to customize the content and/or layout of our page for each individual visitor; 4) used to notify consumers about updates to our Web site; 5) purposely shared with other organizations to help them contact Registered Users for marketing purposes, or otherwise made publicly visible to the general public as well which may lead to desirable and/or undesirable solicitations; 6) used by us to contact consumers for marketing purposes; shared with other organizations for commercial purposes.
With respect to cookies:
We use cookies to store visitors preferences, record session information, such as items that consumers add to their shopping cart, record user-specific information on what pages users access or visit, alert visitors to new areas that we think might be of interest to them when they return to our site, record past activity at a site in order to provide better service when visitors return to our site, ensure that visitors are not repeatedly sent the same banner ads, customize Web page content based on visitors' browser type or other information that the visitor sends.
